We have heard learned counsel for the petitioners and the learned Standing Counsel for the State-respondents.
Admittedly, a proceeding in respect of land in question was pending before the Board of Revenue and the Board of Revenue, after hearing the learned counsel for the parties, remitted back the matter to the Sub Divisional Magistrate for deciding afresh in the light of the observations made in the order.
Thus, the relief sought for in this writ petition cannot be entertained as Public Interest Litigation.
We are, therefore, of the view, that the writ petition is mis-conceived and is, accordingly, dismissed in limine.
