Radhe Shyam Singh v. Smt. Rukhasana Khatun - WRIT - C No. 11215 of 2007 RD-AH 3738 (2 March 2007)
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner .
By this writ petition the petitioner has prayed for quashing the order dated 11.10.2006 passed by the Motor Accident Claims Tribunal allowing the amendment application of the claimant. An application for amendment was moved by the claimant that the number of the Truck as mentioned in the Claim petition "HR 07- 7131" be directed to be corrected as "HR 07- 7137" . The Motor Accident Claims Tribunal heard the parties and relied on the fact that the truck number "HR 07- 7137" was seized from the spot and the owner of the truck got it released and against the same truck the police has filed the charge sheet. This was not a case for introducing a new truck in the claim. The lower court has rightly come to the conclusion that there was error in the number given in the claim hence the claimant has been permitted to correct such number. Valid reasons have been given by the Motor Accident Claims Tribunal for allowing the amendment . The order does not warrant any interference Under Article 226 of the Constitution by this Court.
The writ petition lacks permit and is dismissed.
