This writ petition has been filed for quashing the order dated 20th January, 2007 that has been passed by the Sub-Divisional Officer, Chitrakoot permitting the private respondent no. 3 Makkhan to lift the essential commodities and at the same time giving liberty to the petitioner to seek a clarification of the order dated 9th January, 2007 passed by this Court.
The fair price shop license of the petitioner was cancelled by the order dated 30th July, 2005 against which he filed an appeal. In the meantime the vacancy arising out of the cancellation of the fair price shop of the petitioner was filled up by grant of license to Sri Makkhan. The appeal filed by the petitioner was allowed by the order dated 20th November, 2006 but this order was challenged by Makkhan by filing Writ Petition No. 907 of 2007 in which an order was passed on 9th January, 2007 directing the parties to maintain status quo. In our opinion, as under the order dated 20th January, 2007 the petitioner has been given liberty to seek clarification from this Court of the order dated 9th January, 2007 passed in the aforesaid writ petition, there is no good reason to interfere with the said order.
The writ petition is, accordingly, dismissed.
