Heard Sri A.S. Diwekar and Sri Meerajuddin, learned counsel for petitioner, learned Standing Counsel as well as Sri Anil Bhushan, Advocate, for respondents.

Petitioner has approached this Court, requesting therein that Regional Joint Director of Education, Agra Region, Agra be directed to consider the representations of the petitioner dated 01.12.2003, 10.02.2004 and 10.04.2006, and not to give effect to the order dated 07.10.2003.

Brief background of the case is that in the district of Aligarh there is a recognized institution known as Adersh Lakshma Inter College, Aligarh. In the said institution Yogesh Chandra Sharma has been promoted from the post of Assistant Teacher to lecturers grade in Hindi, against the vacancy which had occurred on 30.06.2001 on account of attaining the age of superannuation by one Hari Lal Deo Sharma. Claim of petitioner is that he is entitled to be promoted to the said post of lecturer in Hindi, as the same is liable to be filled up by of promotion from amongst OBC category candidates. Claim of petitioner for providing him promotion on account of his being from OBC category is untenable, inasmuch as, qua OBC category candidates no reservation has been provided for in promotion, as such the claim of petitioner is unfounded, and in this background there is no occasion to direct the authority concerned to consider the claim of petitioner.

Writ petition lacks substance and the same is dismissed.
