Heard Sri Akhilesh Srivastava learned counsel for the applicant and learned AGA for the State and perused the papers.
The accused is said to have been arrested while making illicit arms on 15.12.2006.
Main submission made by the learned counsel for the applicant is that no public witness was called at the time of alleged arrest and recovery. It is also submitted that the applicant has been falsely implicated in this case due to village party- bandi and enmity.
On the contrary, the bail of the applicants has been opposed by the learned AGA.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.
Let the applicant Shakir S/o Noor Mohammad involved in Case Crime No. 499 of 2006, under section 5/25 Arms Act, P.S. Sasnigate Gate, District Aligarh be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
