  Wajiuddin Khan                 versus        State of U.P. and others

Heard counsel for the parties and perused the record.

The petitioner is working as class III employee in Nagar Palika Parishad, Rampur.

The grievance of the petitioner is that he has not been paid salary due from 23rd September, 2006 till date. He has made a representation dated 26.12.2006(Annexure-6 to the writ petition) before the Executive Officer, Nagar Palika Parishad, Rampur regarding payment of salary due from 23rd September, 2006 till date but to no avail.

The only prayer of the counsel for the petitioner at this stage is that a direction may be issued to the Executive Officer, Nagar Palika Parishad, Rampur to decide the aforesaid representation of the petitioner dated 26.12.2006 within a time bound frame fixed by this Court.

The Standing Counsel appearing for the respondents has no objection to the aforesaid prayer.

In the circumstances, the writ petition is disposed of finally with a direction to the Executive Officer, Nagar Palika Parishad, Rampur to decide the aforesaid representation of the petitioner dated 26.12.2006  (Annexure-6 to the writ petition) by a reasoned and speaking order, in accordance with law, within a period of four months from the date of production of a certified copy of this order.

If the petitioner is aggrieved by the decision of his representation, he may approach the Labour Court under the Payment of Wages Act under Section 6(H)(2) of the Industrial Disputes Act, which is pari-materia to Section 33-C (2) of the Act.
