Objection filed by the State, be taken on record.
Heard learned counsel for the appellant-accused, learned AGA for the State and perused the objection and impugned judgment.
It is contended by the learned counsel for the appellant accused that the victim alleged to have been recovered in a police encounter but anyhow he has returned to house. The evidence on record and the prevailing circumstances do not indicate that he was forcibly abducted and the co-accused Mohabbat Singh who alleged to have been apprehended on the spot in a police encounter, has already been released on bail in Criminal appeal no. 1232/07.
Considering the facts and circumstances of the case, but without expressing any opinion on the merit of the case, the appellants have made out a case for their release on bail.

The appellant Angad convicted under Section 364A IPC in Sessions Trial No. 161 of 2005 P.S. Kotwali Distt. Etawah shall be released on bail on his furnishing a personal bond of Rs.50,000/-with two sureties each in the like amount to the satisfaction of the court concerned.
The realisation of the fine imposed upon the appellant shall remain stayed during the pendency of their appeal before this Court.
