Heard counsel for the parties and perused the record.
The father of the petitioner died on 23.8.1987 while he was working as conductor in the respondents Nigam at Ghazipur Depot. The mother of the petitioner applied for appointment on compassionate ground in his place in 1993. She submitted all the certificates in this regard as required but did not submit her High School certificate.
Thereafter an application was moved in 1998 by the mother of the petitioner requesting the authority concerned to appoint her son in her place. The application of the petitioner was rejected on the ground that it was moved beyond the period of limitation from the date of death of his father.
From the record it appears that the mother of the petitioner was not granted appointment by the respondents as she had not completed all the formalities for compassionate appointment, hence the petitioner could not have been appointed in her place on compassionate ground after the death of mother.
There is no illegality or infirmity in the order of rejection of the representation of the petitioner on the ground of limitation even otherwise no case for compassionate appointment is made out in the facts and circumstances of the case above.
For the reasons stated above, the writ petition is dismissed. No order as to costs.
