Contention of the petitioner is that he applied for consideration of his candidature for the post of Police Constable. Petitioner has contended that he was finally selected. Petitioner has further contended that he was asked to submit affidavit and in the said affidavit he disclosed of criminal cases wherein he has been charge sheeted. Qua one criminal case information was given that petitioner has been acquitted and qua one criminal case information was furnished that same is still pending. Petitioner has contended that he has not concealed any material fact and said criminal cases are not of such magnitude to deprive the petitioner of his candidature being rejected, and till date Senior Superintendent of Police Gorakhpur has not taken any decision in the matter.

In these circumstances and in this background liberty is given to the petitioner to make fresh representation within three weeks from today alongwith the certified copy of this order before Senior Superintendent of Police Gorakhpur Respondent no. 3, who shall consider the claim of the petitioner and take appropriate decision on the same in accordance with law  preferably within next six weeks from the date of presentation of certified copy of this order. Whatever decision so taken, same be communicated to the petitioner.

With the above direction present writ petition is disposed of.
