This appeal has been filed by Ram Chandra, Sudama and Aditya @ Tika against the judgement and order dated 19.12.2006 passed by Addl. Sessions Judge, F.T.C., No. 2, Kannauj in S. T. No. 327 of 2002 whereby the appellants have been found guilty and convicted under Section 307/34 IPC and have been sentenced to undergo rigorous imprisonment up to ten years and fine has also been imposed on them.
Sri A. K. Singh has filed parcha on behalf of complainant, keep it on record.
Heard learned counsel for the parties and perused the impugned judgement.
Learned counsel for the appellants has contended that according to prosecution case, appellant Ram Chandra is alleged to have caused fire arm injuries to the complainant on his left arm. The other two appellants are not alleged to have caused any injuries to the injured.
In the circumstances of the case, appellants Sudama and Aditya @ Tika be released on bail, during pendency of this appeal, on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
They shall also deposit the amount of of fine as imposed on them and shall also furnish an undertaking that they will not indulge in any criminal or antisocial activity and if any report is found against them it shall be open for the court below to report to this Court so that their bail may be cancelled.
For considering the bail matter of Ram Chandra, trial court record is required. Record be requisitioned within four weeks.
List on 16.1.2007. In the mean time, learned A.G.A. may file written objection if any, against the prayer for bail.
