This appeal has been filed by Ram Naresh and Rakesh against the judgement and order dated 22.11.2006 passed by Addl. Sessions Judge, Court No. 4, Mainpuri in S. T. No. 504 of 1997 whereby the appellants have been found guilty and convicted under Section 307/34 IPC and have been sentenced to imprisonment for five years and fine has also been imposed on them with default stipulation.

Heard learned counsel for the parties and perused the impugned judgement.

Admit.

Learned counsel for the appellants has contended that role of firing has been assigned to Ram Naresh and that of catching hold to Rakesh.

In the circumstances of the case, but without prejudice to the merits of the case, appellant Rakesh be released on bail, during pendency of this appeal, on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.

He shall also deposit the amount of  of fine as imposed on him and shall also furnish an undertaking that he will not indulge in any criminal or antisocial activity and if any report is found against him it shall be open for the court below to report to this Court so that his bail may be cancelled.

For considering the bail matter of Ram Naresh, trial court record is required. Record be requisitioned within four weeks.

List on 13.2.2007. In the mean time, learned A.G.A. may file written objection if any, against the prayer for bail.
