Chief Jusitce's Court
Special Appeal No. 206 of 2007
Takkar Singh vs. District Judge, Kanpur and another
Counsel for the appellant :Mr. Bholewshar Gautam
Counsel for the respondents :Mr. K. R. Sirohi
Hon'ble H.L. Gokhale,CJ
Hon'ble Ashok Bhushan,J
1. Heard learned counsel for the appellant and learned counsel appearing for the District Judge.
2. The appellant was appointed in a class-IV vacancy on a temporary capacity. It was a short term appointment, for just about a year. Although the panel for regular appointment was drawn and the name of the appellant was included therein, before the name of the appellant would come up for consideration for substantive appointment, the life of the select list expired. This being the position, the appellant could not be given appointment on a substantive basis. One of the grounds which has been accepted by the learned Single Judge is that the appellant did not apply after an advertisement came up subsequently on 22.10.2001. In view of this state of affairs, the learned Single Judge did not find any merit.
3. In our view, there is no error in the order passed by the learned Single Judge. The appeal is dismissed.
