1. Heard counsel for the petitioners, Standing Counsel and Sri K.N. Mishra for respondents.
2. According to the petitioners they have been selected in pursuance of the advertisement No. 31 published by the U.P. Higher Education Service Commission, Allahabad and recommendation for their appointment has been sent by respondent no. 3, yet the Committee of management is not giving appointment to them on the ground that duly selected persons are already working in the college.
3. In the circumstances of the case, the petitioner may file representation before respondent no. 3. In case any such representation is filed, that may be decided by the concerned respondent by a speaking order, if possible, within three months from the date of receipt of the representations. The petitioner will file certified copy of this order, other necessary documents and duly stamped self addressed envelope along with his representation. The concerned respondent after taking decision will communicate the same to the petitioner. Needless to add that respondent no. 3 before passing any order may also give opportunity to the college concerned.
4. With these observations the writ petitions are disposed off.
