Objection has already been filed in Criminal appeal no. 1106 of 2007.
Heard Sri R.S.Shukla, learned counsel for the appellants-accused, Sri Manoj Kumar Singh, learned counsel for the informant, learned AGA for the State and perused the objection and impugned judgment.
It is contended by the learned counsel for the appellants accused that the appellants did cause no injury to the deceased. There is solitary injury on the person of the deceased and the same is alleged to have been caused by the co-accused Balbir.
Considering the facts and circumstances of the case, but without expressing any opinion on the merit of the case, the appellants have made out a case for their release on bail.
The appellants Arjun and Ajaipal convicted under Section 302 read with Section 149, 148 IPC in Sessions Trial Nos. 698 of 2005, 710 of 2005 and 711 of 2005 P.S. Katra Distt. Shahjahanpur shall be released on bail on their furnishing a personal bond of Rs.50,000/-each with two sureties each in the like amount to the satisfaction of the court concerned.
The realisation of the fine imposed upon the appellants shall remain stayed during the pendency of their appeal before this Court.
