Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. After 10 days of the lodging of the F.I.R. the evidence of last seen was collected by the I.O. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Sudesh involved in case crime no. 266 of 2006 under Sections 302,201 I.P.C. and 3(2)5 Ss.C./S.T. Act P.S. Kandhla District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
