Heard counsel for the petitioner and the learned Standing Counsel. In view of the order that we propose to pass, it is not necessary to invite counter affidavit.

The petitioner by means of the present writ petition prays for the following reliefs:-

"Issue a writ order or direction in the nature of certiorari quashing the impugned order dated 15.12.2006 passed by Assistant Collector, 1st Class, Basti for summoning the same as the copy of the  same was never served upon the petitioner and was not available to the petitioner inspite of best efforts.

Issue a writ order or direction in the nature of  mandamus directing the respondents not to interfere in the peaceful possession of the petitioner over the land belonging to the petitioner being gate no. 18/0.66, 91/0.425 and 92/0.32 situated in village Tenuwa Pargana Basti, Tehsil and District Basti."

The counsel for the petitioner has stated that the impugned order dated 15th December, 2006 passed by the Assistant Collector, 1st Class Basti has never been served upon the petitioner and nor it has come to his knowledge.

Without entering into the merits of the petitioners case, we direct the Assistant Collector, 1st Class Basti that in case any such order as is referred by the petitioner has been passed, it shall be supplied to the petitioner within a period of ten days from the date of filing an application along with the copy of order.

With these observations, the writ petition is finally disposed of.
