HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon. Anjani Kumar, J.

Hon. Dilip Gupta, J.

This writ petition has been filed for a direction upon the Post Office not to make payment of the National Saving Certificate and Kisan Vikas Patra to private respondent no. 3.

A perusal of the averments made in the writ petition indicates that there is a dispute between the petitioner and private respondent no. 3 as to who is entitled to receive the said payment.

We are of the considered opinion that such a dispute cannot be resolved under Article 226 of the Constitution. We, therefore, decline to entertain this petition and, accordingly, dismiss it with liberty to the petitioner to take appropriate proceedings before the Competent Court, if so advised.
