Heard learned counsel for the petitioner as well as the learned Standing Counsel appearing for the respondents and have perused the record.
The petitioner is aggrieved by an order dated 12.10.2006 by which he has been dismissed from service.
A preliminary objection has been raised by the learned Standing Counsel that under the U.P.Government Servant (Discipline and Appeal) Rules, 1999, which governs the service of the petitioner, the petitioner has an alternative remedy of filing an appeal under Rule 11 of the aforesaid Rules.
As such, since the petitioner has an alternative remedy of appeal, which has not been availed by him, I would not be inclilned to interfere with this writ petition.
This writ petition is, accordingly, dismissed without there being any order as to cost. The petitioner shall, however, be at liberty to file an appeal before the appellate authority, in accordance with law.
