Heard learned counsel for the petitioner as well as learned Standing counsel appearing for the respondents. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.
The father of the petitioner died in harness on 15.4.2006. The petitioner thereafter on 10.8.2006 filed an application for appointment on the post of Junior Analyticals Assistant on compassionate ground. By the impugned order dated 31.1.2007 the petitioner has been directed to apply for another post inasmuch as the post of Junior Analyticals Assistant has to be filled up by Public Service Commission and compassionate appointment cannot be given on such post. The said reason appears to be justified and in my view no interference is called for with the impugned order.
However, considering the fact that the father of the petitioner had died in harness, it is provided that the respondent-authorities may consider the claim of the petitioner for being given compassionate appointment, in accordance with law, on any suitable post on which the petitioner may be found entitled to, expeditiously, preferably within a period of three months from the date of filing of a certified copy of this order before the Respondent no.2.
With the aforesaid observation/direction, this writ petition is disposed of. No order as to cost.
