Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.
The petitioner claims that her husband was initially engaged as Beldar in the Irrigation Department. Subsequently he was appointed as a work-charged employee. He died in harness on 28.8.2003. The petitioner submits that she has filed an application for being provided employement under the Dying in Harness Rules, 1974 which application has been pending despite the petitioner having filed several representations in this regard.
Having heard learned counsel for the parties andn considering the facts and circumstances of this case, this writ petition is disposed of with the direction that in case if, with regard to her grievances made in this writ petition, the petitioner files a fresh comprehensive representation before the Executivie Engineer, Ban Sagar Sangathan, Nahar Construction Division - 10, Mirzapur, Respondent no.3, along with a certified copy of this order as well as copy of the application initially made by her for grant of compassionate appointment under the Dying in Harness Rules, the same shall be considered and decided by the said Respondent no.3, in accordance with law, expeditiously, preferably within a period of two months from the date of filing of the same.
With the aforesaid observation/direction, this writ petition is disposed of. No order as to cost.
