HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon. Anjani Kumar, J.

Hon. Dilip Gupta, J.

This petition has been filed for quashing the notice dated 23rd February, 2007 that has been issued by the Executive Engineer directing the petitioner to vacate the house in dispute.

The said house was allotted in favour of respondent no.4. The petitioner claims to have been depositing the money on behalf of Atar Singh. There is no allotment order in his favour. In such a situation the notice requiring the petitioner to vacate the house as he is an unauthorised occupant, does not suffer from any infirmity.

The writ petition is, accordingly, dismissed.
