Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. After investigation the I.O. came to the conclusion that the applicant was falsely implicated in the present case that is why final report was submitted which was challenged by the first informant by way of filing the protest petition then the learned magistrate has summoned the applicant to face the trial for the offence. It is alleged that the evidence of hatching conspiracy come forward. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Khalil Ahmad involved in case crime no. 628 of 2003 under Sections 364,376,302,120-B I.P.C. and section 3(v)(x) of the S.C./S.T. Act P.S. Dhampur District Bijnor be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
