Salary to teachers working in Junior High Schools is ensured under U.P. Junior High Schools (Payment of Salaries to Teachers and Other Employees) Act, 1978. The State Government has taken policy decision to include one thousand such institutions under grant-in-aid list of the State Government
This Court in Civil Misc. Writ Petition No.64708 of 2006 has passed following order:
"The facts giving rise to the present writ petition are squarely covered by the judgment and order of this Court in writ petition No,57868 of 2006 (Tilakk Singh v. State of U.P. and others) decided on 18th October, 2006.
Accordingly, this petition is also disposed of in terms of the judgment and order of this court referred to above, and it is provided that the petitioners shall be be entitled to the benefits of the said judgment."
In these circumstances and in this background, Director of Education (Basic) U.P. at Lucknow is directed to see that only validly selected and appointed teachers are ensured salary under the U.P. Junior High Schools (Payment of Salaries to Teachers and Other Employees) Act, 1978. In this regard qua each and every incumbent, who are to be paid salary, Director of Education is obliged to make enquiry and thereafter names of such teachers be forwarded.
In terms of above observations and direction, writ petition is disposed of.
