The petitioner was allotted the land in dispute for setting up a Theme Amusement & Entertainment Park. A lease was also executed in favour of the petitioners on 28.2.2002. Subsequently two notices, namely 7.10.2004 and 19.10.2004 were issued to the petitioners under the Stamp Act. The petitioners filed the writ petition against these notices. The Court while entertaining the writ petition passed an order that the final order may be passed but it will not serve on the petitioner without leave of the court.
A counter affidavit has been filed annexing with the copy of the order dated 13.10.2006 and permission is sought for serving the same. The petitioner has filed an affidavit that he does not wish to challenge the same. In view of this, the petition has become infructuous.
The amount as calculated in the order may be deposited in three equal monthly instalments. The first monthly instalment may be paid by 31.1.2007, the second one may be paid by 28.2.2007 and third one may be paid by 31.3.2007. In failure of deposit of the amount mentioned herein the respondents may proceed to recover the entire amount in accordance with law.
With these observations the writ petition is disposed of.
