Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the applicant and other co-accused persons caused injury by using kicks and fists. The co-accused Naresh had caused injury by using danda blow. The fatal injury was caused by the co-accused Baljeet. The co-accused Naresh whose case is on the same footing with the applicant, has been released on bail by Hon'ble Shiv Shanker,J. on 14.12.2006 in criminal misc. bail application no. 22316 of 2006. The case of the applicant is distinguishable with the case of the co-accused Baljeet.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Manoj involved in case crime no. 310 of 2003 under Sections 147,149,224,225,302,332,352,353, 504 and 506 I.P.C. P.S. Sikhera District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
