Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the F.I.R. itself the evidence of last seen is against the applicant. There is no direct eye witness account. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Nanhe involved in case crime no. 672 of 2006 under Sections 302,201 I.P.C.,3(2)(V) S.C./S.T. Act P.S. Bilsanda District Pilibhit be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
