Heard learned counsel for the applicants and learned A.G.A.
This application has been filed against order dated 28.7.2006 passed by Addl. Sessions Judge/F.T.C. II, Azamgarh in sessions trial No. 66 of 2003 wherein application under section 311 Cr.P.C. filed by the applicants have been rejected. From the perusal of the application under section 311 Cr.P.C. and the points taken therein and from the perusal of the impugned order it appears that points taken therein to re-examine the witness is not essential to just decision of the case. The impugned order is perfect order, it does not require any interference, therefore, prayer for quashing the impugned order is refused.
Accordingly this application is rejected.
