Heard learned counsel for the petitioners and the learned A.G.A for the State.

Perused the allegations of the first information report and the material placed on record.

Issue notice to respondent no. 4 who may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit in the meantime.  Rejoinder affidavit, if any, may thereafter be filed within one week.

List thereafter.

Till the next date of listing or till submission of charge sheet whichever is earlier the arrest of the petitioners namely Manoj Pandey and Mahendra Kumar Agarwal  in case crime no. 114 of 2007 under sections 384, 506 and 427 I.P.C., police station Sikandara, District Agra shall remain stayed provided they cooperate with the investigation. .
