Heard learned counsel for the petitioner and the learned A.G.A.
The averments in the FIR are sought to be supported by averments of the complainant that he has a receipt issued by the accused for payment of Rs.9,000/- which was made to the accused by the complainant. In view of this corroborative documents, it is difficult at this stage to the fact that remaining averments in the FIR are not correct.
In the circumstances, we do not find any good ground for either quashing the FIR, or staying the arrest.
However, if the petitioner surrenders and applies for bail in Case Crime No. 303 of 2007, u/s 323/504/506/406 IPC of P.S.Chandausi, District-Moradabad, his bail application will be considered and disposed of by the Courts below expeditiously.
The writ petition is disposed of as above.
