Heard learned counsel for the petiitoner as well as Sri Siddharth Saran, learned counsel appearing for the sole respondent. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.
Challenging an order dated 4.8.2005 whereby the application of the petitioner for disability pension had been rejected, the petitioner filed a statutory appeal before the sole respondent on 17.11.2005. The submission of the learned counsel for the petitioner is that despite the petitioner having filed several representations thereafter, the appeal of the petitioner has yet not been decided although more than a year has passed.
Considering the facts and circumstances of this case, this writ petition is disposed of with the direction that the appeal of the petitioner filed on 17.11.2005 be heard and decided by the respondent, in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of filing of a certified copy of this order before him.
With the aforesaid observation/direction, this writ petition is disposed of. No order as to cost.
