Heard learned counsel for the petitioner and perused the record.
By an order dated 14.7.2006 certain punishment had been imposed on the petitioner against which he filed an appeal which has also been dismissed on 29.12.2006. Challenging the said orders the petitioner has filed this writ petition.
Learned Standing counsel has pointed out that under Rule 23 of the U.P.Police Officers of Subordinate Ranks (Punishment and Appeal) Rules, 1991 the petitioner has an alternate remedy of filing a revision before the next higher authority which has not been availed by the petitioner.
In view of the fact that the petitioner has an alternate remedy of filing a revision, which has not been availed by him, I would not be inclined to entertain this writ petition.
This writ petition, is accordingly, dismissed.
However, it is observed that in case if the petitioner files a revision before the competent authority within three weeks from today, along with a certified copy of this order, the same shall be heard and decided on merits without taking any objection with regard to delay.
