This application has been filed by the applicant, against the order dated 6.12.2006 passed by the Judicial Magistrate, Saharanpur in complaint case no. 73 of 2006 under sections 323,427,392,386,506 I.P.C. P.S. Gagoh district Saharanpur whereby the learned Magistrate has taken cognizance and summoned the applicant to face the trial.
From the perusal of the record it appears that the order impugned is not suffering from any illegality or irregularity. Therefore, the prayer for quashing the same is refused.
However, considering the allegations made in the application and considering the fact that the applicant is Junior Engineer in the office of S.D.O. it is directed that the applicant shall appear in the court concerned within 30 days from today. If he applies for bail, the same shall be disposed of on the same day in accordance with the provisions of law. For a period of 30 days from today no coercive measures shall be taken against him.
In case , the applicant is released on bail and applies for exemption his appearance in the court concerned, the application for the same shall be considered and disposed of in accordance with the provisions of law.
With this direction this application is finally disposed of.
