Heard learned counsel for the applicant and the learned A.G.A. and Sri R.K. Srivastava, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that according to the prosecution version the applicant and co-accused Parvez discharged shots by the country made pistol but nobody received any injury from their shots. The specific role of causing injury to the deceased is attributed to the co-accused Saim Khan alias Seema.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Babban Khan
involved in case crime no. 815 of 2005 under Sections 302,307,324,452 and 506 I.P.C.P.S. Bhojipura District Bareilly be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
