We have heard Sri Amaresh Sinha, learned counsel for the appellant.

This is an appeal filed on behalf of the Insurance Company for quantum of amount awarded by the Claims Tribunal as there is no permission as required under Section 170 of the Motor Vehicles Act.  The appeal filed by the Insurance Company is not maintainable.  The same is hereby dismissed.

There shall be no order as to  costs.
