Criminal Misc. Bail Application No. 3429 of 2007 has been filed by Jawahar Gond son of Rama Nand Gond and Criminal Misc. Bail Application No. 2355 of 2007 has been filed by  Munni Lal @ Munil son of Rama Nand for release on bail in case crime no. 101 of 2006, under Sections 147, 148, 149, 307 IPC, P.S. Bansdih Road, District Ballia.

Since these two matters arise out of the same case crime, they are being heard and decided by a common order.

Heard learned counsel for the parties and perused the material on record.

Learned counsel for the applicants has contended that applicants are alleged to have cased firearm injuries but the injuries were pellet injuries and no supplementary report was filed. He has also contended that injuries were also received from the side of the applicant. However, learned counsel for the complainant denies that it is a cross case.

In the circumstances of the case, but without prejudice to the merits of the case, applicant is entitled to bail.

Let the applicants be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.

The applicants shall furnish an undertaking also before the C.J.M. concerned that they will not indulge in any criminal activity and will not cause either any threat or any physical violence to the complainant and the witnesses and their family members. If any such report is made by any of the above person either to the Court or the police, it shall be properly inquired into and if any substance therein is found, it shall be open for the court below to take necessary legal action against the applicants.
