Heard learned counsel for the petitioners and learned standing counsel. In view of order proposed to be passed it is not necessary to issue notice.
The petitioners, aggrieved by an order passed by the Board of Revenue dated 5th September 2006 whereby a revision filed by the petitioners has been dismissed on merits as not maintainable.
The order against which the revision was filed is the order dated 3.8.2006 whereby the first revision filed by the contesting respondent was accepted and the matter was directed to send back to the trial court while maintaining the order dated 6th September 2005 and 11th April 2005. By these two orders the trial court has been directed to decide the matter. Considering the operating portion of the order and in the interest of justice I find that since the matter has already been remanded back to trial court none of the rights of the petitioners are affected at this stage. I find no case at this stage. The writ petition is dismissed.
