Heard learned counsel for the petitioner as well as learned Standing Counsel for the respondents. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.
The husband of the petitioner was in the service of the Public Works Department. He died in harness on 2.9.2003 leaving behind the petitioner (widow) and three children. The petitioner filed an application on 31.8.2005 for being provided appointment on compassionate ground as well as for payment of death-cum-retiral benefits of her late husband. Learned counsel for the petitioner submits that although nearly two years have passed since such application had been made, the respondent-authorities have not decided the same.
Having heard learned counsel for the parties and considering the facts and circumstances of this case, this writ petition is disposed of with the direction that in case if, with regard to her grievances made in this writ petition, the petitioner files a fresh comprehensive representation before the Executive Engineer, Mechanical Division, Public Works Department, Bareilly, Respondent no.5, along with a certified copy of this order, the same shall be considered and decided by the said respondent, in accordance with law, after giving an opportunity of hearing to the petitioner and other concerned parties, if there be any, expeditiously, preferably within a period of two months from the date of filing of the same.
With the aforesaid observation/direction, this writ petition is disposed of. No order as to cost.
