By means of the present writ petition, petitioner has challenged the award dated 31.03.1990 passed by Presiding Officer, Labour Court, Bareilly.
Brief facts of the case are that the petitioner was the employee of the respondent no.2, M/s Raza Textiles Limited, Rampur. The services of the petitioner was terminated on 27.06.1986 on the basis of the report given by the enquiry officer that on 27.05.1985 petitioner was indulged in fighting with the labourers which caused injury to the another employee, Muazzam. The incident was supported by the evidence of the victim, Muazzam and the by the statement of two other labourers, namely, Hotey Lal an dram Bharosey. In view of the aforesaid incident it was held that above incident had disturbed the peace of the institution which affected the production. Presiding Officer, Labour Court upheld the termination of the petitioner.
Heard learned counsel for the parties.
I do not find any error in the award given by the Presiding Officer, Labour Court Bareilly, which is based on the evidence on record and does not require any interference by this Court.
Writ petition is accordingly, dismissed.
