Heard Sri G.K. Singh, learned counsel for the petitioner and Sri Y.K. Sinha, learned counsel for the respondents.

This writ petition is directed against the transfer order dated 10.3.2006 (Annexure-1 to the writ petition) as well as the order of suspension dated 7.4.2006 (Annexure-3 to the writ petition) passed by respondent no. 2.

Learned counsel for the respondents at the outset stated that the petitioner did not comply the order of transfer dated 10.3.2006 and therefore, he was placed under suspension by order dated 7.4.2006 as a result whereof the petitioner has been directed to continue with his office at Naini itself and during the period of suspension and inquiry, there is no question of giving effect to the order of transfer dated 10.3.2006. Therefore, in view of the order of suspension the writ petition against the order of transfer has rendered infructuous.

Sri G.K. Singh, learned counsel for the petitioner at this stage submitted that the respondents be directed to complete the departmental inquiry expeditiously since the order of suspension has been passed on 7.4.2006 and almost 10 months have already been passed thereafter.

In view of the aforesaid statement and facts and circumstances of the case, without entering into the merit of the issues raised by the learned counsel for the parties, the writ petition is finally disposed of directing the respondents to complete departmental inquiry against the petitioner expeditiously preferably within a period of 6 months from the date of production of certified copy of this order.
