Smt. Sumitra Devi v. State Of U.P. & Others - WRIT - A No. 16549 of 2007 RD-AH 5650 (29 March 2007)
Hon'ble Vineet Saran, J.
Heard learned counsel for the petitioner and perused the record.
The petitioner is aggrieved by the selection of Respondent no.5 as Aanganbari Karyakatri. It has merely been submitted by the learned counsel that since the petitioner is older in age than the Respondent no.5, hence as per the terms of the Government Order dated 16.12.2003 she should be given appointment. In the said Government Order what is said is that in case if two candidates have obtained equal quality point marks, then the senior in age would be given preference in appointment. The petitioner has not been able to show that she as well as Respondent no.5 were both equally placed. Since the Respondent no.5 is awarded higher quality point marks by the Selection Committee, hence she has been selected. In such a situation the provisions of giving appointment to the one senior in age would not be applicable. As such the petitioner would not be entitled to the reliefs prayed for.
This writ petition is, accordingly, dismissed. No order as to cost.
