The father of respondent no. 1 (contesting respondent) was a Store Keeper in the factory of the petitioner. He died on 31.10.1989. The respondent no. 1 was offered appointment under Dying in Harness Rules on 22.07.1990. Subsequently, the services of the contesting respondent were terminated on 10.02.1992. He filed Original Application before the Central Administrative Tribunal. This application was allowed on 13.12.2005 directing the petitioner to offer fresh appointment to the contesting respondent on the availability of the vacancy. Hence, the present writ petition.
We have heard counsel for the petitioner and Sri H.N. Singh, counsel for the respondent.
The services of the respondent no. 1 were not continued as criminal case was pending against him. He has been acquitted in the criminal case. In view of the same there is no illegality in the impugned order. However, the petitioner may be given fresh appointment only on the vacancy in the quota meant for compassionate appointment.
With these observations wit petition is disposed of.
