We have heard the learned counsel for the petitioners and Sri Pankaj Naqvi for the respondents.
In view of the notification dated 21.12.2006 the Executive Council at its meeting held on 2.3.2006 considered the matter pertaining to seniority of the teachers who are appointed under the Career Advancement Scheme (in short CAS) from their due date of eligibility and vide their resolution no. 25 dated 22.3.2007 has inter alia resolved that the seniority in case of those teachers who are appointed under CAS be counted from their due date of eligibility. In view of this resolution and notification the counsel for the petitioners stated that the writ petition has become infructuous.
The writ petition is accordingly dismissed as infructuous. The notification dated 21.12.2006 produced by the learned counsel for the petitioners shall be treated as part of the writ petition.
