HIGH COURT OF JUDICATURE OF ALLAHABAD

Court No. 40.

Civil Misc. Writ Petition No. 17042 of 2007.

Shiv Ram

Versus

Deputy Director of Consolidation, Banda and others.

----------------

Hon'ble Vikram Nath, J.

Heard learned counsel for the parties.

This writ petition arises out of chak allotment proceedings and is directed against the order of the Deputy Director of Consolidation dated 9.1.2007 whereby he partly allowed the revisions filed by Smt. Paragia and Kallu and altered the chaks accordingly.

From a perusal of the order of the Deputy Director of Consolidation it appears that he had adjusted the equities between the parties.  Plot No. 309, admittedly, is the original holding of the petitioner as also Kallu.  It is a low value plot.  This plot had been given to Kallu. The Deputy Director of Consolidation allotted the said original holding to the petitioner and also Kallu so that both of them may share it partly.  This reason given by the Deputy Director is a just reason.  The second reason given by the Deputy Director of Consolidation is that Smt. Paragia be allotted a chak over her original holding being Plot No. 284, after removing her Udan Chak over Plot No. 103 so that she gets a chak close to the chak of her husband, also appears to be sound.   Both the reasons given by the Deputy Director of Consolidation do not suffer from any infirmity in the matter of allotment of chak and therefore the order impugned in this Writ Petition does not suffer from any infirmity

This Writ Petition lacks merit. It is, accordingly, dismissed.
