It is submitted by the petitioner's counsel that the petitioner is a poor and illiterate person living below the poverty line and has no source of income and has no property from which the amount can be paid and the respondents are threatening to arrest the petitioner by recovering the sum of Rs. 15,000/- said to have been advanced for purchase of buffalo from the Bank. The petitioner has only paid a sum of Rs. 7,500/-
Respondents 4 and 5 are granted three weeks time to file counter affidavit.
List this case on 24.4.2007.
Until next date of listing the respondents are restrained form arresting the petitioner in pursuance of recovery of the loan. It is made clear that recovery by other process has not been stayed.
