Heard learned counsel for the petitioners.
The petitioners, aggrieved by an order dated 19th September 2006 passed by the revisional authority, Additional Commissioner, Saharanur Division, Saharanur, approached this Court by means of this writ petition under Article 226 of the Constitution of India. By the order dated 19th September 2006 the revision of the petitioners has been dismissed as not maintainable in view of the fact that proceedings under Section 198 (4) of U.P. Zamindari Abolition & Land Reforms Act lies only against the allotment of land. In the present case the petitioners have not been able to demonstrate or establish that there is allotment of any land in their favour. In these circumstances the view taken by the Assistant Commissioner that no revision lies cannot be said to be erroneous. In case there is any remedy available to the petitioners they can avail the same.
In view of what has been stated above the writ petition has no force and is accordingly dismissed.
