Heard learned counsel for the petitioner and the learned A.G.A. for the State.

Perused the allegations of F.I.R. and the material on record.

It is submitted by learned counsel for the petitioner that the recovered goods were released in favour of one Harendra and he had also made payment of the sales tax.   After about two years CID (I.O.W.) issued direction to the Station House Officer for arresting the petitioner.

In the circumstances, this petition is disposed of with the direction that till submission of charge sheet the arrest of the petitioner in case crime no. 162 of 2005 under section 419, 420, 424, 120-B, 467, 468 I.P.C. and 28-A of Trade Tax Act police station Delhi Gate District Aligarh shall remain stayed provided he cooperates with the investigation.
