Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.

It is the case of the petitioners that they have been working as Seasonal Collection Amins since 1990. It has been submitted that as per U.P. Collection Amins Service Rules, 1994, 35% of the posts of Collection Amins are to be filled up from amongst the Seasonal Collection Amins. The petitioners submit that there are posts vacant for such purpose but the case of the petitioners is not being considered for regularization as Collection Amins although the petitioners have all the requisite qualifications and seniority for such regularization. It has further been submitted that the persons junior to the petitioners are being permitted to continue as Seasonal Collection Amins but the case of the petitioners for the same has also not been considered. With regard to such grievances, the petitioners have already filed several representations before the respondent-authorities, which have yet not been decided.  

Having heard learned counsel for the parties and considering the facts and circumstances of this case, this writ petition is finally disposed of with the direction that in case if, with regard to his grievances made in this writ petition, the petitioner  files a fresh comprehensive representation before the respondent no. 2, the District Magistrate/Collector, Kushinagar   alongwith a certified copy of this order, the same shall be considered and decided by the said respondent, in accordance with law, as expeditiously as possible, preferably within two months from the date of filing of the same.

It is further provided that in case if the work is available, the case of the petitioners for being permitted to continue to work as Seasonal Collection Amins would be considered on the basis of their seniority, alongwith other Seasonal Collection Amins.

With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to costs.
