Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner is Class-IV employee and is serving as Chaukidar in Joint Hospital, Moradabad. By the impugned order dated 30.11.2006 he has been transferred to Community Health Centre, Thakurdwara, District Moradabad on administrative ground.
During the course of argument it was stated by learbned counsel for the petitioner that the transfer has been made on malafide inasmuch as the respondent no,. 3 is a clerk in the hospital and is related to respondent no. 4. From the argument made by the learned counsel for the petitioner it appears that the petitioner and Sri Satish, the respondent no. 4 serving as Sweeper in the same hospital are not keeping good relations. The petitioner was appointed on compassionate ground and living in the Hospital Compound for the last several decades. There have been differences between the family of the petitioner and respondent no. 4. In order to maintain peace, the Chief Medical Officer has transferred the petitioner to Thakurdwara. I do not find that there is any good ground to interfere in the transfer order. The transfer orders have been passed to maintain peace in the hospital.
The writ petition is dismissed.
