This is an application of the respondents. The respondents contended before this Court that since the election has already been held and now committee has been formed pursuant to earlier direction passed by this Court on 20.7.2007 the interim arrangement to nominate a judicial officer by the District Judge has become infructuous. However, in view of the circumstances, the respondents are entitled to take appropriate steps in the court below. The order impugned is superseded by this clarification order arose out of the order passed on 23.3.2007 by the Civil Judge (Senior Division).
Learned counsel appearing for the appellant in opposition of this application contended that the order may be passed not only when the election is held but also recognized. However, since this Court has already directed that appropriate application is to be made in the court below the appellant is at liberty to take the plea before the court for the purpose which he has raised hereunder. The appropriate order will be passed by the court below upon hearing the parties.
This application is disposed of.
