Learned A.G.A. submits that the objection has already been filed in criminal appeal no. 2025 of 2007.
Heard Sri P.N. Mishra, learned Senior Counsel with the assistance of Sri B. Pant, learned counsel for the appellant-accused, learned A.G.A. for the State and perused the impugned judgment.
It is contended by the learned counsel for the appellant-accused that the role of catching hold of the deceased has been attributed to the appellant-accused and the co-accused Ajay Singh who was armed with iron rod has already been released on bail vide order dated 29th March, 2007 passed in criminal appeal no. 2025 of 2007. The case of the appellant stands on better footing from the case of co-accused.
Considering the facts and circumstances of the case but without expressing any opinion on the merit thereon the appeal is admitted.

The appellant Isham Singh convicted under section 302 IPC in S.T. No. 317 of 2001, P.S. Medical, District Meerut shall be released on bail on his furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the court concerned.
The realization of half of the fine imposed upon the appellant-accused shall remain stayed during the pendency of his appeal and the remaining half of the fine shall be deposited forthwith and the same is to be paid to the parents of the deceased.
